    To vote here in The Netherlands you must present your passport or driving licence or residence permit or ID card.

    It becomes devisive if the cost of such an ID card becomes prohibitive or that the ID presented is used for other things than ballot support.

      Many people who live in cities don't have driver's licenses because they don't drive. And of course most people living in inner cities are minorities. So the ID laws specifically target them. And they claim well you can get a state issued ID. Oh really? Where do you get one when they close most the state offices and the only choice is to travel long distances and wait in line for hours. Its voter suppression by constantly trying to put more obstetricals to voting hoping to discourage minority voters.

    One of America's foremost constitutional law experts revealed why two lawsuits filed in Washington, DC may present the biggest legal threat facing former President Donald Trump.

    Harvard Law Prof. Laurence Tribe, who has argued three-dozen cases before the U.S. Supreme Court, was interviewed Monday evening by MSNBC's Lawrence O'Donnell.

    O'Donnell questioned the constitutional law expert about a new column he wrote for the Boston Globe. In it, Tribe examined all of the legal jeopardy facing the former president and identified the legal strategy he thinks offers Trump the most peril.

    "Yet it is a no-frills lawsuit filed March 30 by two Capitol Police officers who stood their ground against the insurrectionists, and paid a heavy physical and psychological toll for doing so, that holds perhaps the greatest promise of making Trump pay for directing the violent mob that stormed the Capitol on his command," Tribe wrote.

    "The strength of the suit by Officers James Blassingame and Sidney Hemby is in its time-tested simplicity. Not relying on any act of Congress but merely invoking common-law principles buttressed by Washington, D.C., code provisions prohibiting incitement to riot and provocation of violence, their suit centers on claims that Trump directed, aided, and abetted the garden-variety torts of assault and battery and intentional infliction of emotional distress," he explained. "These are the kinds of tort claims pleaded every day in courts across the country, tracing their roots to the most foundational precepts of the English common law. The complaint alleges that Trump was guilty of 'intentional, wanton and reckless conduct' as he 'spurred' a violent crowd 'already primed by his months of inflammatory rhetoric' to cause grave damage and injury to property and persons, including the two Capitol Officers."

    The legal mechanism is that since Trump is a resident of Florida, while the officers likely live in Washington, DC, Maryland or Virginia, it becomes a "diversity lawsuit" -- which allows U.S. District Courts to decide questions of state laws because the parties are residents of different states.

    MSNBC's O'Donnell noted how quickly the number of cases using such a legal strategy could mushroom.

    "And this lawsuit, this same lawsuit is available to at least about 140 Capitol Police officers who were injured that day," O'Donnell noted. "They could file similar lawsuits, similar claims, some of them would be assigned different dollar values by juries if they get to juries. You could have a bankrupting amount of these kinds of lawsuits being filed by just Capitol Police officers alone."

    "Right," Tribe replied. "Unless some of the Capitol Police officers happen to be citizens and residents of Florida, which I very much doubt. But all of the others could file suits just like this."

    "And they all seek not only compensation, though they don't glamorize it, but compensation for the harm, plus punitive damages to punish the president for what he did," he continued. "And to deter future presidents. So these are very standard lawsuits and I can imagine that the emotional as well as legal appeal of these lawsuits to a garden variety jury will be very large. So when you combine the lawsuits that are also strong brought by members of Congress with these suits, it's hard to see how the president will not be held accountable."

    "And I think that is good for the future of this country," Tribe added.

    Michigan AG Says Sidney Powell’s Claim that ‘No Reasonable Person’ Would Believe Her Kraken Theories Is Exactly Why She Should Be Sanctioned

    Defending herself from more than $1 billion in liabilities from Dominion Voting Machines, lawyer Sidney Powell argued late last month that that “no reasonable person” would believe that her conspiracy theories were factual. Michigan Attorney General Dana Nessel (D) cited that concession to argue that the pro-Trump lawyer’s meritless litigation is sanctionable.

    “These attorneys seemingly made statements they knew were misleading in an effort to further their false and destructive narrative,” Nessel wrote in a statement on Wednesday. “As lawyers, fidelity to the law is paramount. These individuals worked to further conspiracy theories in an effort to erode public trust in government and dismantle our systems of democracy. Their actions are inexcusable.”

    On Tuesday, the attorney general filed a supplemental briefing on behalf of Michigan Gov. Gretchen Whitmer (D), Secretary of State Jocelyn Benson (D), drawing a federal judge’s attention to Powell’s latest defense against the more than $1 billion in liabilities that she faces from Dominion Voting System’s defamation lawsuit.

    Powell’s so-called Kraken lawsuits advanced outlandish theories drawing together deceased Venezuelan autocrat Hugo Chavez, multiple foreign powers, local governments across the United States, and Dominion in a supposed plot to hand President Joe Biden the election. Sued by Dominion, Powell later floated the defense that a reasonable person would not have taken her claims to be statements of fact.

    “Analyzed under these factors, and even assuming, arguendo, that each of the statements alleged in the complaint could be proved true or false, no reasonable person would conclude that the statements were truly statements of fact,” her lawyer Lawrence Joseph wrote late last month, floating a defense that previously worked for Fox News host Tucker Carlson.

    However helpful Powell may believe that argument to be in guarding against Dominion’s defamation claims, Whitmer, Benson and Nessel find that it undermines her position in persuading a federal judge that she should not be sanctioned with attorney fees.

    “In their prior briefs, defendants have gone to great pains to show that no reasonable person would believe the claims advanced by plaintiffs in this case. Plaintiffs have pushed back on Defendants’ arguments, but now Ms. Powell herself has admitted as much,” Nessel’s assistant Heather S. Meingast wrote, highlighting those words in original.

    “If there were any doubts about counsel’s mindset when filing this action, Ms. Powell has put them to rest—she and her co-counsel knew there was no reasonable basis for the statements they made in this litigation, but they made them anyway,” the brief continues.

    In early February, the state of Michigan joined the city of Detroit in seeking to disbar Powell and the rest of her “Kraken” team. The word Kraken alludes to the mythical octopus-like creature given the Hollywood treatment in “Clash of the Titans.”

    “Although Ms. Powell’s attempt inevitably failed, it served a second, more sinister purpose—one that is not easily remedied, even by the court’s dismissal of baseless legal claims: it cast unwarranted doubt on the results of Michigan’s free and fair elections,” their bar complaint stated. “Indeed, it undermined the faith of millions of Americans in our democracy and the legitimacy of our President.”

    Michigan filed the motion for sanctions separately from the bar complaints.

    Reached for comment, Powell supplied a terse statement in an email to Law&Crime: “‘Horsefeathers’ and another political publicity stunt.”
