    Wisconsin judge allows for lawsuit against fake Trump electors to proceed




    MADISON, Wis. (AP) — A Wisconsin judge on Monday refused to break up a lawsuit filed against 10 fake electors for former President Donald Trump and two of his attorneys, saying the case could proceed in the county where it was filed.

    The lawsuit seeks $2.4 million from the fake electors and their attorneys, alleging they were part of a conspiracy by Trump and his allies to overturn his loss in the 2020 presidential race. It also seeks to disqualify the Republicans from ever serving as electors again.

    Fake electors met in Wisconsin and other battleground states where Trump was defeated in 2020, attempting to cast ballots for the former president even though he lost. Republicans who participated in Wisconsin said they were trying to preserve Trump’s legal standing in case courts overturned his defeat.

    Nine of the 10 fake electors in Wisconsin, and one of Trump's attorneys, argued that the lawsuit against them was wrongly filed in Dane County Circuit Court. Since none of them lived in that county, they argued, the lawsuit should be refiled against each of them in their respective home counties.


    But Dane County Circuit Judge Frank Remington disagreed on Monday, saying the lawsuit was properly filed because, in part, at least one of the defendants appears to live in Dane County or does not present evidence to the contrary.

    One of Trump's attorneys, James Troupis, and fake elector Scott Grabins, the former Dane County Republican Party chair, both live in Dane County. Neither of them provided any evidence of where they lived, the judge said. Neither did Trump attorney Kenneth Chesebro, who practices law in the Boston area.

    Attorneys for the fake electors who don't live in Dane County argued that a 2007 state law allows for venue changes to courts in the defendant's home county in cases that relate to elections or election law. The lawsuit alleges that the defendants broke several criminal and civil laws when they met at the Wisconsin state Capitol on Dec. 14, 2020, in an attempt to cast the state’s electoral votes for Trump.

    Remington said the law requires that the case be heard in Dane County where it was filed.

    “Wisconsin law does not allow the problematic consequences of ten judges simultaneously litigating the same claims in ten different courts, or ten juries — some 120 jurors — hearing the same claims and rendering ten different verdicts,” Remington wrote.

    The lawsuit was filed a year ago this month by two Democratic electors and a voter. They are represented by the Madison-based Law Forward law firm and the Institute for Constitutional Advocacy and Protection at the Georgetown University Law Center.

    “Although likely not the last, this was just the latest effort to delay any type of accountability,” said Law Forward attorney Scott Thompson. “We are pleased this matter will be resolved in the Dane County Courthouse, just one block from where the fake electors scheme was carried out.”

    Attorneys for the fake electors did not immediately respond to an emailed request for comment.

    Remington last week also revived a complaint brought by Law Forward against the fake electors filed with the Wisconsin Elections Commission. That complaint sought sanctions against the fake electors.

    Remington ruled last week that the complaint must be heard again because a commissioner who considered the complaint last time should have recused himself. That commissioner, Robert Spindell, also served as a fake elector and is one of the defendants in the lawsuit seeking damages.

    President Joe Biden won Wisconsin by nearly 21,000 votes, a result that has withstood recounts, partisan-led investigations, a nonpartisan audit and multiple lawsuits.

    A group chaired by pro-Trump attorney Lin Wood is struggling to find people to attest to the lawyer's "good character" ahead of a disciplinary hearing stemming from his false claims of fraud in the 2020 election.

    On Sunday, the #Fightback foundation posted a plea for Wood's supporters to appear at a hearing after Georgia's State Bar brought an action against him. Wood was a central figure behind the movement to keep then-President Donald Trump in power following his loss in the 2020 election.

    "We would like for all who have known Wood well enough to attest to his good character and reputation to do so. If you are in the area and are willing to provide brief live testimony, we ask that you please come and do so," the notice said. "We also would be grateful for any letters of recommendation attesting to Lin's good character and reputation."

    Last year, a federal judge declined to hold Wood in contempt for posting a video recording of a court hearing while trying to overturn the 2020 election.

    But another judge ruled against Wood's motion to dismiss the State Bar's complaint in Georgia.

    This week's disciplinary hearing is scheduled for Thursday at 10:00 AM.

    The first witness in the opening day of former gubernatorial candidate Kari Lake’s trial, in which the Republican alleges Maricopa County didn’t verify signatures on ballot envelopes, was a woman who spent days verifying signatures.

    “Your focus was on quality of signatures, not the quantity of signatures, is that correct?” Deputy County Attorney Jack O’Connor asked the woman, Jacqueline Onigkeit, who sat in the witness stand of a wood-paneled courtroom in Mesa.

    “That is correct,” Onigkeit said.

    Onigkeit was Lake's first witness on Wednesday, but her testimony appeared to support the county's contention that even Lake's witnesses would be a "marching band" for their case.


    Lake's day in court on Wednesday included a slate of witnesses who laid the groundwork for what's to come and a few twists, too, including a call to law enforcement, though exactly why was unclear.

    The trial began Wednesday on a single issue that has wound from county court to the Arizona Supreme Court, which dismissed most of the case, and back.

    Lake lost the governor’s race to Democrat Katie Hobbs by about 17,000 votes and has not conceded, instead continuing to claim in court that she should be named governor or Maricopa County should redo its election.

    The former candidate and Phoenix television anchor sat in the back row of Superior Court Judge Peter Thompson’s courtroom through opening statements but left midmorning. Opening statements gave attorneys for Lake, as well as defendants Maricopa County, Hobbs and the secretary of state, a chance to provide a road map of the case ahead.

    The crux of the issue at trial is whether Lake can prove, with clear and convincing evidence, that Maricopa County didn’t do any signature verification, which is required by state law.

    Lake's challenging the work of county employees whose job was to compare whether a signature on a voter’s ballot affidavit envelope from the 2022 election matched signatures in the voter’s records. If signatures don’t appear consistent on an initial review, the county uses two other levels of review before it determines whether to count or to try to cure the ballot.

    Lake attorneys say verification happened too quickly
    Lake is represented by Kurt Olsen and Bryan Blehm, who have both previously worked on efforts to challenge the results of the 2020 election, and who were fined earlier this month by the Arizona Supreme Court for lying during the ongoing court proceedings.

    Blehm, in questions to witnesses on Wednesday, repeatedly and mistakenly asked about the 2020 election.

    Olsen laid out Lake’s case, urging the judge to pay attention to the small amount of time it took some workers to verify signatures.

    “This isn't a question of not doing it well enough, they're simply not doing signature verification,” Olsen said. “Maricopa received a flood of 1.3 million ballots in the 2022 general election. … The evidence will show that the signatures were either not reviewed at all, or that the signature verifiers were simply clicking through the computer screen and moving on to the next ballot without doing any cross-reference to the record signature.”

    Olsen said he could show that an 11-step process for verifying signatures was not followed, and that more than 270,000 signatures were deemed consistent with less than three seconds of review each, which he said was not enough time to truly verify if they were a match.

    “Signature verification is not an art,” Olsen said. “You don't look at signatures like a Picasso and decide whether you like it.”

    He played a video of signature verification workers that appeared to show one person scrolling horizontally through records, which Onigkeit testified later wasn’t in line with signature verification procedures. Those procedures required scrolling vertically to view signatures that were already in a voter record for comparison.

    However, Rey Valenzuela, the director of elections for Maricopa County, told the court why it could appear that one worker was moving quickly through those records without scrolling down while another was taking more time.

    First-level reviewers look at batches of 250 signatures twice, he said, a first time that requires scrolling to see comparison signatures on file, and a second time to make sure they made a determination on each of the 250 ballots. That second look could happen quicker, he said, adding that Olsen was taking the video out of context.

    Onigkeit testified that she felt pressured by second-level reviewers to work quickly and re-review ballots she had already rejected. Other witnesses included Andrew Myers, who testified he also verified signatures and raised concerns about staffing levels that were disputed by Valenzuela.

    Lake also called as witnesses Shelby Busch and another activist with We The People AZ Alliance, a political action committee whose reviews questioning election results were aired at the Arizona Legislature, but discredited by the county. Those witnesses' testimonies were brief and mostly procedural, establishing that they obtained public records from the county that are part of Lake's case.

    County confident in verification process
    Tom Liddy, civil division chief for Maricopa County Attorney’s Office, said Lake’s witnesses were actually a “marching band” for the county’s case. They are also just a few of the 155 people who did first-review signature verification for the county, he said.

    Those people were all monitored by a supervisor, who had removed the signature verifier in the video presented by Olsen, Liddy said. He said the county went beyond its legal obligation to check signatures by using a three-tiered process, and Valenzuela is expected to testify more about those steps on Thursday.

    Who does what? Maricopa County approves limited changes to elections agreement

    Liddy, in closing his opening statement to the judge, referenced Olsen’s words about a flood of ballots.

    To verify those are from registered voters is “an extraordinary Herculean effort, which Maricopa County proudly accepts because when 1.3 million people turn out to vote, it's not a flood. It's a great day," he said.

    It also was Liddy who on Wednesday afternoon asked the judge for a sidebar — essentially a meeting between the attorneys and the judge that the public cannot hear. Liddy said the matter was urgent and showed something on his cellphone screen to the judge and Lake's lawyers.

    Judge Thompson proceeded with a scheduled afternoon break, during which four law enforcement officers went into his chambers at the Mesa courthouse. The Maricopa County Sheriff's Office did not immediately confirm details about the incident.

Because she no only consistently proves she know what she is doing she also demonstrates she knows what she is dealing with Including knowing all hell is going to break loose when she indicts Trump. So she is easing to that giving lots of hints and foreshadowing that is what she is going to do. And that does more than just give authorities forewarning to be prepared for all hell to break loose. Doing it in little hints months in advance also gets people used to the idea. They can see it coming so when it does its not such a shock which helps defuse the reaction.


    Fulton County DA Fani Willis letter hints at time frame for Trump indictment

    According to a report from the Atlanta Journal-Constitution, Fulton County District Attorney Fani Willis submitted a letter on Thursday to government officials that hints at a several-week block in August when an indictment against Donald Trump may come down.

    The report states Willis informed Fulton Superior Court’s chief judge Ural Glanville that a substantial number of her staff will not be in the office for a period of ten days during a three-week period up to August 18.

    She wrote, "This remote work will reduce the number of Fulton County District Attorney’s office staff in the Fulton County Courthouse and Government Center by approximately 70 percent,” with the AJC's Tamar Hallerman adding that Willis and her closest advisers and armed investigators will be the only ones on hand in the office.

    According to the report, those dates coincide with dates when the grand jury investigating Donald Trump and his close associates' attempts to tamper with the 2020 election results will be convening.

    A federal judge has ordered Rudy Giuliani to provide a detailed accounting of his finances and net worth in connection with a lawsuit filed by two Georgia poll workers who contend the Trump lawyer defamed them by publicly accusing them of fraud in the 2020 presidential election.

    U.S. District Court Judge Beryl Howell issued the order during an unusual hearing Friday on ongoing disputes about access to Giuliani’s evidence related to the suit brought by Ruby Freeman and Wandrea Moss two years ago.

    During the nearly 3-hour hearing, Howell repeatedly expressed irritation at having to expend considerable time on the discovery dispute, which she suggested should have been worked out by the parties.

    “I can’t say I’m happy about it,” the judge said, later referring to Giuliani’s efforts to search for relevant emails and messages as a “murky mess.”

    While the court session explored a variety of issues about evidence in the case, much of the focus was on Giuliani’s claim in a recent court filing that he could not perform further searches of emails and other records stored in an electronic database because the vendor was seeking $320,000 to allow that. The former mayor, U.S. Attorney and Justice Department official said he simply could not afford that sum.

    Howell said Giuliani’s “claim of poverty” meant that the plaintiffs were entitled to insight into his finances.

    An attorney for Giuliani, Joseph Sibley, said the plaintiffs should not be provided some personal information, like court filings detailing Giuliani’s obligations in his 2019 divorce from his third wife, Judith Nathan.

    But Howell said the plaintiffs were entitled to know about Giuliani’s financial condition, including the divorce-related payments, before deciding whether to help foot the bill for document searches in the case. Typically, parties must handle their own costs to comply with discovery obligations.

    “I think that would be pertinent to evaluating his financial net worth,” the judge said.

    Giuliani interjected at various points in the lengthy hearing, sometimes despite signals from Sibley asking his client to hold back. The former mayor said complying with the document demands in the poll workers’ libel suit was complicated by the fact that the FBI seized all of his electronics in April 2021, as prosecutors investigated potential violations of foreign-agent laws in connection with Giuliani’s work in Ukraine.

    “The FBI took every electronic device in my apartment and my law office,” said Giuliani, who often reminded the judge about his days as a federal prosecutor. “Having done this work at one time in my life, this was about as exhaustive as you can get.”

    Giuliani was never charged in the investigation, which has been closed.

    “I’ve been dealing with this for 50 years. I understand the obligation,” an indignant Giuliani added. “There’s nothing I want to hide. I’d like them to see everything. … Not being perfect doesn’t mean you’re deleting things. I don’t delete things.”

    Giuliani explained that he’d run various keywords himself through his social media apps and other accounts, but Howell questioned the thoroughness and accuracy of that. “This manual search is unverifiable,” she said.

    An attorney for the poll workers, Meryl Governski, said the plaintiffs got emails from third parties they subpoenaed that were sent to or from Giuliani but that he never produced in the litigation.

    “We think the time has come for him to engage professional help,” Governski told Howell.

    Sibley told the judge that a former lawyer for Giuliani is trying to work out a payment plan with the vendor who has the data gathered by the FBI, but could not offer a timetable to resolve that dispute.

    “This is torture by process,” Giuliani muttered as he left the courtroom during a break. He later made a somewhat more restrained complaint to the judge.

    “This is punishment by process. ... I get what they’re doing,” the former mayor declared.

    Howell, an appointee of former President Barack Obama, had ordered that Giuliani appear in person for Friday’s hearing. That, too, is rare since lawyers typically hash out such issues without their clients present.

    In addition to ordering Giuliani to detail his finances, the judge gave him a deadline of the end of the month to identify all the devices and other forms of records storage he used during the time period relevant to the suit.

    The suit at issue Friday accuses Giuliani of defaming Freeman and Moss by alleging that they conspired to exclude observers from an Atlanta ballot counting site, that they hid stacks of unauthorized ballots on election night and introduced them into ballot-counting machines. The women say the claims are nonsense and have caused them to be subjected to harassment.

    An earlier version of the suit also sought damages from the company behind One America News, two of its owners and one of its employees who worked closely with Giuliani. The parties connected to One America News reached a settlement with Freeman and Moss about a year ago, leaving Giuliani as the sole remaining defendant in the suit.

    After the hearing, Giuliani declined to speak to reporters about the document fight. “I don’t comment on discovery disputes,” he said.

    However, outside the courthouse, he held forth on a series of other subjects. He portrayed himself as a victim of a “fascist state” seeking to punish anyone who provided legal counsel to former President Donald Trump.

    “Your rights have been seriously impinged by the fascist tactics that have been used in order to get Donald Trump, one of them being persecuting his attorneys,” Giuliani said.
