Senators urge Trump administration to resume Equifax probe

Democratic senators and consumer advocates on Monday urged the Trump administration to resume an investigation into how Equifax failed to protect the personal data of millions of consumers after Reuters reported that the head of the U.S. consumer watchdog has pulled back on the existing probe.

In September, Equifax Inc said hackers had stolen personal data it collected on some 143 million Americans.

On Monday, Reuters reported that Mick Mulvaney, head of the Consumer Financial Protection Bureau (CFPB), has dialed back the investigation begun by his predecessor, Richard Cordray.

Specifically, sources said Mulvaney has held back from ordering subpoenas against Equifax – a routine step in launching a full-scale probe. Meanwhile, the CFPB has shelved plans for on-the-ground tests of how Equifax protects data, an idea backed by Cordray.

The CFPB also recently rebuffed bank regulators at the Federal Reserve, the Federal Deposit Insurance Corp and the Office of the Comptroller of the Currency when they offered to help with on-site examinations of credit bureaus, said two sources familiar with the matter.

“The (Trump) administration should get on the side of consumers and focus on making sure hacks like the #EquifaxBreach don’t happen again,” tweeted Senator Mark Warner, a Democrat.

Warner and fellow Democrat Elizabeth Warren, both members of the Senate Banking Committee, have proposed reforms that could have cost Equifax hundreds of millions of dollars in fines if they had been in place last year.

Mulvaney is leading the CFPB on a temporary basis, and the Senate will have a say on any long-term replacement.

Senator Sherrod Brown, the highest-ranking Democrat on the banking panel, said Trump should name a permanent CFPB chief now.

“The Administration needs to swiftly nominate a CFPB director who will protect consumers instead of letting well-connected corporations walk away scot-free,” Brown said in a statement.

The National Consumer Law Center, an advocate for financial protections, said the CFPB should be leading the investigation into the Equifax breach.

“With half of the U.S. population victimized, you think there’d be universal agreement that Equifax should be held accountable for its incompetence,” said attorney Chi Chi Wu.

In addition, they count as clients some of the giants in high tech, including companies like Microsoft, Apple, and Google. Those companies also impose on Equifax a higher standard of security than other companies. It is certain that data held by Equifax is more secure than any individual company can claim.
Government agencies have already examined the breach and how it happened, and have cleared Equifax of any wrong doing or lapse in security.

Trump’s FEMA tapped unproven entrepreneur to give 30 million meals to Puerto Rico — she only delivered 50K

The Federal Emergency Management Agency last year gave a big contract to an Atlanta-based entrepreneur who had no experience in large-scale disaster relief — and she completely failed to meet the goals set for her by the agency.

The New York Times reports that Tiffany C. Brown, who was awarded a $156 million contract to deliver meals to Puerto Ricans suffering from the aftermath of Hurricane Maria last year, delivered only around 50,000 meals by the time she was supposed to have delivered 18.5 million.

The issue, reports the Times, is that “the food had been packaged separately from the pouches used to heat them,” whereas “FEMA’s solicitation required ‘self-heating meals.'”

Because of this, FEMA canceled Brown’s contract, which had originally called on her to deliver 30 million meals to the hurricane-stricken U.S. territory.

Although FEMA says that it relied on other contractors to deliver meals to Puerto Rico after the contract with Brown fell through, the Times writes that “there is little doubt that in the immediate aftermath of Hurricane Maria, Puerto Ricans struggled with access to food” since “the storm shut down ports on an island that imports about 85 percent of its food supply.”

Brown is now seeking a settlement of $70 million in exchange for the terminated contract, as she claims to the Times that FEMA never told her that meals had to be shipped together with their heating pouches.

Trump’s staff secretary resigns after ex-wives claim physical abuse

White House staff secretary Rob Porter has resigned over abuse allegations by his ex-wives.

Porter’s second wife, Jennifer Willoughby, told reporters he was physically abusive during their marriage, which left her “walking on eggshells” to avoid his explosive anger.

His first wife, Colbie Holderness, confirmed she left Porter because “he was verbally, emotionally and physically abusive.”

She shared photos of herself with a black eye she claims Porter gave her.

Both women say they informed the FBI about Porter’s abuse during a background check before he started working at the White House.

President Donald Trump’s chief of staff John Kelly defended Porter after the women went public, saying the White House official was “a man of true integrity and honor, and I can’t say enough good things about him.”

But Porter, who denies the allegations, stepped down Wednesday.

WASHINGTON — A much-ballyhooed White House proposal to boost domestic manufacturing might be stuck in the pipeline.

More than a year after President Donald Trump demanded that oil and gas pipelines built in the U.S. be constructed with U.S.-made steel — roiling the energy industry in Texas and beyond — there is little evidence that the Trump administration is close to making that idea a reality.

A July deadline for the U.S. Commerce Department to produce such a plan went by without the release of any details. Trump has dropped the idea from his speeches, where it was once a prominent fixture. And groups tracking the proposal say it has just fallen off the radar.

"With little explanation, it has vanished," said Scott Paul, president of the Alliance for American Manufacturing, which supported Trump's "Buy American" effort.

That inaction could reflect concerns that the mandate would be unfeasible and potentially in violation of international trade law. Or it could result from resistance by companies like Dallas' Energy Transfer Partners, which called the idea "well-intentioned" but "unworkable."

But the jam doesn't mean the push is altogether dead.

The Commerce Department, which didn't respond to requests for comment, could always press ahead. The White House's plan for a $1.5 trillion infrastructure package could be a new vehicle. And some trade cases involving steel imports could offer an indirect way to address the issue.

"The pipeline stuff just quietly went away," said Philip Bell, president of the Steel Manufacturers Association. "And there weren't a lot of people, with the exception of the steel producers, really disturbed about it."

The exact status of the "Buy American" pipelines proposal is unclear.

The White House, like the Commerce Department, did not respond to requests for comment. And industry stakeholders said they weren't sure where it all stands, though they said they had not seen any such plan and agreed that there are few signs the idea will reemerge in its initial form.

But Trump could still have an influence.

That could come through the White House's long-promised infrastructure plan. Or another potential flash point is in the area of trade, where Trump, for instance, is taking a long look at whether the U.S. should impose steep tariffs on imported steel.

And those kind of moves could again stir up the energy and manufacturing bases.

John Stoody of the Association of Oil Pipe Lines, for example, said some of Trump's trade rhetoric is an "ongoing concern." But Paul, the manufacturing alliance boss, said trade could be a way for Trump to "make good on his campaign promises and American-made inclinations."

Donald Trump “declines to participate” in reading the Presidential Daily Brief, breaking from his previous seven predecessors and potentially “hampering his ability to reposed to crises,” the Washington Post reports.

A source told the Post that reading the top-secret document offered to the president every morning is not Trump’s preferred “style of learning.”

As the Post notes, shortly after he took office, intelligence analysts crafted a method to brief Trump–who prefers photos and graphics to large swaths of text. As he told Axios last year, “I like bullets or I like as little as possible. I don’t need, you know, 200-page reports on something that can be handled on a page.”

Eventually, ”Trump made clear he was not interested in reviewing a personal copy of the written intelligence report,” the Post reports. Instead, he opts for an oral briefing.

Former CIA director Leon Panetta told the Post that Trump’s reliance on oral briefings means he’s missing critical nuance that’s easier to grasp with written intelligence details.

“If for some reason his instincts on what should be done are not backed up by the intelligence because he hasn’t taken the time to read that intel, it increases the risk that he will make a mistake,” Panetta warned.

“You can have the smartest people around you—in the end it still comes down to his decision,” he added.

Despite aides’ assurances that Trump receives a briefing nearly every morning, the president’s public Trump’s schedule indicates he receives an in-person intelligence briefing every two to three days, on average. Meanwhile, top officials receive “versions of the president’s written intelligence briefing,” the Post reports.

Trump sometimes complains briefers are “talking down to him,” one source told the Post. He also “often goes off on tangents during the briefing and you’d have to rein him back in,” a person said.

Donald Trump’s Inaugural Committee Still Won’t Say What It’s Doing With Its Leftover Money
It’s been over a year, and it could be many more months until the public knows where these funds are going.

Representatives for President Donald Trump’s inaugural committee still won’t say what the committee did—or plans to do—with the tens of millions of dollars it pledged to charity last year. And it may be many more months until the public finally knows.

The committee smashed the record for inauguration fundraising, bringing in about $107 million, double the sum raised for Barack Obama’s first inauguration, which held the previous record. But Trump’s inaugural committee only spent about half of that money. The rest, it said, would go to philanthropic ends.

More than a year later, no one knows what those ends will be.

A spokesperson for Tom Barrack, Trump’s personal friend and the chairman of the committee, told The Daily Beast on Dec. 8 that it would be filing an annual report detailing its charitable giving with the Internal Revenue Service “in the next several weeks.” It is now Feb. 12, and it still hasn’t done so and there is no indication of when it will.

The committee doesn’t have to wait for a 990 filing to say where it directed leftover funds, noted Brendan Fischer, the director of federal and FEC reform programs at the Campaign Legal Center, an ethics group. “Even if the inaugural committee does need more time to file its 990, there is nothing stopping it from voluntarily disclosing how it spent the leftover funds, and whether any money went to charity,” he said in an email.

“Tom Barrack said the inaugural committee would disclose charitable contributions in Fall,” Fischer added, “then pushed the deadline back to November, and now here we are in February and the public still has no idea how the inaugural committee spent $107 million.”

Barrack announced that the committee would donate $3 million to three charities involved in hurricane relief efforts. That pledge came after The Daily Beast inquired about the potential use of inaugural committee funds to support such efforts in the wake of Hurricane Harvey.

Two former Trump business partners tell Forbes that Trump brought up plans to build a Trump Tower in Georgia during his meeting with Prime Minister Giorgi Kvirikashvili last May.

As president, Trump has vowed to not be involved in making deals that benefit his businesses and has instead given responsibility for running his businesses to his sons, Eric Trump and Donald Trump Jr.

According to The New Yorker, Trump first unveiled plans to build a Trump Tower in the Georgian city of Batumi in 2011.

What’s more, the New Yorker writes that the proposed deal to fund the tower’s construction raised concerns about whether the project would be used as a vehicle to launder money.

“The deal, for which Trump was reportedly paid a million dollars, involved unorthodox financial practices that several experts described to me as ‘red flags’ for bank fraud and money laundering,” the publication writes. “Moreover, it intertwined his company with a Kazakh oligarch who has direct links to Russia’s President, Vladimir Putin.”

Trump's Biggest Potential Conflict Of Interest Is Hiding In Plain Sight

The largest American office of China's largest bank sits on the 20th floor of Trump Tower, six levels below the desk where Donald Trump built an empire and wrested a presidency. It's hard to get a glimpse inside. There do not appear to be any public photos of the office, the bank doesn't welcome visitors, and a man guards the elevators downstairs--one of the perks of forking over an estimated $2 million a year for the space.

Trump Tower officially lists the tenant as the Industrial & Commercial Bank of China, but make no mistake who's paying the rent: the Chinese government, which owns a majority of the company. And while the landlord is technically the Trump Organization, make no mistake who's cashing those millions: the president of the United States, who has placed day-to-day management with his sons but retains 100% ownership. This lease expires in October 2019, according to a debt prospectus obtained by Forbes. So if you assume that the Trumps want to keep this lucrative tenant, then Eric Trump and Donald Trump Jr. could well be negotiating right now over how many millions the Chinese government will pay the sitting president. Unless he has already taken care of it: In September 2015 then-candidate Trump boasted to Forbes that he had "just renewed" the lease, around the time he was gearing up his campaign.

It's a conflict of interest unprecedented in American history. But hardly unanticipated. The Founding Fathers specifically built this contingency into the Constitution through the Emoluments Clause, which prohibits U.S. officials from accepting gifts, titles or "emoluments" from foreign governments. In Federalist 75, Alexander Hamilton framed the threat thus: "An avaricious man might be tempted to betray the interests of the state to the acquisition of wealth." Scholars have been debating what exactly constitutes an "emolument" since the moment Trump won the election, and nearly 200 congressional Democrats sued the president over possible violations in June. Much of the yammering in this area surrounds Trump's hotels, especially the one in Washington, D.C., which has billed $268,000 in hotel rooms and catering to the Saudi government, and his international licensing deals, which allow foreign tycoons and hucksters, many with connections to their local governments, to pay the Trump Organization more than $5 million a year in order to profit from the president's name in far-flung locales.

But that's all small potatoes. The real money in the Trump empire comes from commercial tenants like the Chinese bank. Forbes estimates these tenants pay a collective $175 million a year or so to the president. And they do so anonymously. Federal laws, drafted without envisioning a real estate billionaire as president, require Trump to publicly disclose the shell companies he owns--but not the hundreds of businesses pouring money into them or even the extent of the money involved.

"The public reading the [disclosure] form doesn't know who is paying the president," says Walter Shaub, who resigned as the federal government's top ethics official in July. The president likes it that way. Neither the White House nor the Trump Organization would provide a list of the president's tenants, much less reveal what they pay. Instead, Trump Organization lawyer Alan Garten provided a statement: "Following the election, the Trump Organization implemented a rigorous vetting process for all transactions, including leases, which includes a detailed review and approval by our chief compliance officer and outside ethics advisor." In other words, government ethics officials, charged with detecting conflicts of interest, have never seen the president's rent roll.

So we created one on our own, identifying 164 tenants, in virtually every industry, from all around the world, and then estimated payments, wherever possible, based on property records, debt prospectuses and conversations with real estate experts. When tenants refused to say how much space they rented, we made in-person visits and took rough measurements. (There were obstacles: The day after we sent questions to the Trump Organization , two security guards kicked a Forbes reporter out of a shopping area of one Trump property.) When we could not get more detailed information, we assumed tenants paid rates comparable to those for similar properties in their respective markets. We believe we've tracked the sources for 75% of the rent flowing into the president's coffers.

The numbers are significant: $21 million here, $12 million there. The names even more so: At least 36 of Trump's tenants have meaningful relationships with the federal government, from contractors to lobbying firms to regulatory targets.

How tangled is it all? Forbes discovered one deal, previously unreported, in which Trump partially serves as his own landlord: The U.S. government is paying some rent to the person who runs it.

Boiled down, the Trump Organization is more a collection of deals than an operating business. While Wal-Mart and General Motors rely on millions of customers around the world, the Trump Organization relies on a handful of large entities. That insulates the president's business from consumer whims--and lagging favorability ratings--while leaving him vulnerable to corporate (or government) interests.

How, then, to consider the backroom discussions between federal officials and Walgreens Boots Alliance, one of the largest pharmacies in the world? Through its brand Duane Reade, it is the highest-paying tenant in Trump's skyscraper at 40 Wall Street in New York, with $3.2 million in annual rent, according to a 2015 prospectus. In October 2015, Walgreens Boots Alliance announced a $9.4 billion merger with rival Rite Aid, requiring a sign-off from antimonopoly regulators. After the deal failed to secure approval under President Obama, it then fell to the Trump administration, which arrived in Washington during the first quarter of 2017. According to federal disclosures, that was the same quarter Walgreens Boots Alliance began directly lobbying the White House on "competition policy issues." In September, despite objections by one of the two commissioners at the Federal Trade Commission, Trump's tenant got the green light for a slimmed-down, $4.4 billion version of the deal. In January, Trump announced he would nominate the commissioner who supported the deal, Maureen Ohlhausen, to be a federal judge.

How much, if at all, did the business relationship affect the government's decision? It's inherently impossible to measure. Walgreens Boots Alliance says there was no connection whatsoever and that their lobbying was not specific to the deal. But even if Trump tried to rule without any personal favor, or if this was decided without his direct input, the appearance of a conflict of interest is unavoidable. The companies know their landlord is the president. And it's hard to get into the heads of regulators, however well-intended or removed from the White House, who serve a president famously obsessed with personal loyalty.

Consider banks. Capital One rents space for an estimated $1 million at the bottom of Trump's Park Avenue condo building--while the Justice and Treasury departments investigate the bank's anti-money-laundering program. Four years ago, the Department of Justice reached a nearly $17 billion settlement--the largest ever of its kind--with Bank of America, the biggest tenant (an estimated $18 million a year) at the 555 California Street complex in San Francisco, where Trump owns a 30% stake. Like all big banks, BofA remains under scrutiny by federal officials. In December, Trump tenants UBS, Barclays and JPMorgan, plus Trump lender Deutsche Bank, got waiver extensions from the Department of Labor that allow them to avoid part of their punishment for illegally manipulating interest rates and foreign exchange rates.

The overlapping interests stretch beyond the financial world. Take any hot-button issue of the past year, and there's a good chance Trump's tenants lobbied the federal government on it, either in support of or in opposition to the administration's position. Nutritional-supplements giant GNC, which rents retail space from the president in New York City, advocated on health care reform. Nike, which pays an estimated $13 million in annual rent to Trump, spoke up on the Trans-Pacific Partnership. Starbucks, with locations in three Trump buildings, weighed in on immigration. Microsoft on net neutrality. Columbia University on the federal budget. There are even three law firms that are tenants and have lobbying divisions that push various client interests--while the firms pay the president a combined $4.1 million each year for rent.

The constitutional issues surrounding a landlord-in-chief transcend the foreign Emoluments Clause. Three months after Trump became president, the U.S. Postal Service, part of the executive branch, started a new lease in a Brooklyn housing development where Trump owns a 4% stake, according to his financial-disclosure report. While he's in process of selling the stake--his lawyer Garten says that Trump's business has no day-to-day control over properties where it holds minority investments--the president and his partners continue to collect an estimated $25,000 in annual rent from the federal government, whose founding charter, the Constitution, appears to prohibit the president from getting any government compensation except for his salary.
