State law provides just two methods for casting an absentee ballot
The News: The Wisconsin Institute for Law & Liberty (WILL) filed a lawsuit in Waukesha County Circuit Court, on behalf of two Waukesha County voters, challenging the legal status and advice from the Wisconsin Elections Commission (WEC) on the use of ballot drop boxes. WILL is asking the court for a declaratory judgment that makes clear that there are just two legal ways to cast an absentee ballot in Wisconsin: through the U.S. mail or delivered in person to the municipal clerk.

The Quote: WILL President and General Counsel, Rick Esenberg, said, “Wisconsin voters deserve certainty that elections are conducted fairly and in accordance with state law. But the Wisconsin Elections Commission is giving advice to clerks that is contrary to the law, putting the ballots of countless voters at risk.”

Background: Absentee ballot drop boxes were used widely during Wisconsin elections in 2020. The Wisconsin Elections Commission (WEC) issued memos to Wisconsin clerks in March and August of 2020 encouraging their use, stating that absentee ballots do not need to be mailed by the voter or delivered by the voter, in person, to the municipal clerk, but instead could be dropped into a drop box. According to WEC, ballot drop boxes can be unstaffed, temporary, or permanent.

This advice was contrary to state law. Voting is a constitutional right, but state law makes clear that, “voting by absentee ballot is a privilege exercised wholly outside the traditional safeguards of the polling place.” There are just two legal ways in Wisconsin to submit an absentee ballot. When voting by absentee ballot, state law says “[t]he envelope [containing the ballot] shall be mailed by the elector, or delivered in person, to the municipal clerk issuing the ballot or ballots.”

 

U.S. Supreme Court gives states more leeway to restrict voting

July 1 (Reuters) - The U.S. Supreme Court on Thursday made it easier for states to enact voting restrictions, endorsing Republican-backed measures in Arizona that a lower court had decided disproportionately burdened Black, Latino and Native American voters and handing a defeat to Democrats who had challenged the policies.

The 6-3 ruling, authored by conservative Justice Samuel Alito, held that the restrictions on early ballot collection by third parties and where ballots may be cast did not violate the Voting Rights Act, a landmark 1965 federal law that prohibits racial discrimination in voting.

President Joe Biden and other Democrats swiftly condemned the Arizona decision and a second one also issued by the justices on Thursday - the last day of rulings for the court's current nine-month term - in a case from California that could endanger some political donor disclosure laws. In both rulings, the court's six conservative justices were in the majority, with the three liberal justices dissenting.

Giuliani’s emails with Fox News demanded in $1.6 billion defamation lawsuit by voting company: report

Bloomberg News reported Thursday that in the lawsuit between Dominion Voting Systems and Rudy Giuliani, lawyers are seeking emails between the defendant and Fox News.

Dominion is suing Fox News, Rudy Giuliani, Mike Lindell and MyPillow and Sidney Powell after those individuals spread lies that the company's equipment stole the election as part of a plot involving a long-dead leader of Venezuela. Those involved are alleged to have done lasting damage to the company's name with unfounded conspiracy theories prompting the $1.6 billion litigation.

"The former New York mayor and Donald Trump's personal lawyer was asked to hand over all documents stemming from his appearances on Fox starting in 2016 as well as all communications with the network related to the 2020 presidential election and Dominion, according to a June 28 filing in state court in Delaware," said the report.

The subpoena outlines any communications about the voting machines company while he was spreading the comments across Fox News and Fox Business in wake of the 2020 election.

All documents whether true or false, "whether formal or informal, compensated or uncompensated" are being sought, according to the subpoena.

Giuliani is working to dismiss the lawsuit he's facing as well as investigations from the Justice Department involving foreign work he did in Ukraine and Turkey.

Continuing to tout the latest 2020 election conspiracy theory, MyPillow CEO Mike Lindell has set a date for Donald Trump’s alleged return to office this summer.

“The morning of August 13, it will be the talk of the world, going, ‘Hurry up! Let’s get this election pulled down,” he told Brannon Howse of Worldview Weekend Broadcast Network. “Let’s right the right. Let’s get these communists out, you know that have taken over.”

According to media watchdog Patriot Takes, which flagged the clip on Twitter, Lindell also claimed, “there will be many down-ticket senators that will have different election results.”

In the wake of a bombshell news report detailing former President Donald Trump twice sought to talk on the phone with the Republican leader of Arizona's most populous county last winter as he and his allies sought to prevent the certification of Joe Biden's 2020 election win.

"But the leader, Clint Hickman, then the chairman of the Maricopa County Board of Supervisors, said in an interview on Friday that he let the calls — made in late December and early January — go to voice mail and did not return them. ... At the time, Mr. Hickman was being pressed by the state Republican Party chairwoman and Mr. Trump's lawyer Rudolph W. Giuliani to investigate claims of fraud in the county's election, which Mr. Biden had won by about 45,000 votes," the New York Times reported on Friday.

Writing for the Arizona Republic this Monday, E.J. Montini contends that in light of these revelations, it's clear that Republicans don't really care that much about alleged election meddling, saying that Hickman "took in on the chin" from Republicans for daring to resist Trump's pressure and praise his state's election integrity.

"It looks to me as if attempted election tampering is now legal in Arizona," Montini writes. "For Republicans."

U.S. Sen. Raphael Warnock, a Democrat elected to the Senate last month, Warnock was listed as the CEO for the New Georgia Project at the time, the New Georgia Project was founded by Democrat Stacey Abrams in 2014.

Now it appears that a criminal investigation has been opened and is looking into some questionable election results connected to Abrams and Warnock.

In 2008, under the best possible conditions for a Democrat, Barack Obama lost Georgia by just over 200,000 votes, or 5.2 percent of Georgians who voted. Four years later he lost again by just over 300,000 votes, or 7.8 percent of Georgians who voted. By any measure the state is a reach for Democrats.

Which brings us to this week. On Tuesday, Georgia Secretary of State Brian Kemp—a Republican—said his office was investigating allegations of voter fraud from the New Georgia Project, following complaints about voter applications submitted by the group.

At least two Arizona state senators shared their expectations of the 2020 election audit to reveal significant fraud. In a tweet on Saturday, Sen. Wendy Rogers (R-Ariz.) shared a report, which cited the alleged preliminary results of the Arizona audit.


The report claimed the audit’s results would reveal large discrepancies between the 2020 ballot count and the actual vote. Rogers stated she and fellow Sen. Sonny Borrelli (R-Ariz.) supported such assessments.

For his part, President Trump has appeared to also support such assessments and asserted Americans have known something was not right with last year’s vote.

“If we lost the election, we would still have a good crowd,” he expressed. “But you know what? I wouldn’t have a crowd that goes beyond what the eye can see, that stays in a thunderstorm…nobody wants to go home.”

Arizona auditors have mentioned their job was not yet finished as they’re set to examine electronic devices used in the 2020 elections.

For months, Lindell has promised that Trump would be back in office in August following a new inauguration.

The MyPillow CEO revealed the date for Trump's takeover in an interview over the weekend.
